These Terms of Service (“Terms”) govern your access to and use of SiteBrew’s website, planning workspaces, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and authority
You must be at least 13 years old and legally able to enter into these Terms. If local law requires a higher minimum age, that higher age applies.
If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization.
2. Accounts
You agree to provide accurate account information, keep it current, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless caused by our failure to use reasonable safeguards.
Workspace owners and administrators may manage membership, roles, access, and content within workspaces they control.
3. The Service
SiteBrew provides tools for planning website structure and content, collaborating with teams and clients, and exporting workspace material. We may improve, modify, suspend, or discontinue features as the Service evolves.
You are responsible for maintaining appropriate copies of content you need. Features identified as previews, demos, beta, or experimental may change or be withdrawn and may not be suitable for production information.
4. Your content
You retain ownership of content you submit to the Service. You grant SiteBrew a non-exclusive, worldwide license to host, copy, process, display, transmit, and otherwise use that content only as reasonably necessary to operate, secure, maintain, and improve the Service.
You represent that you have the rights and permissions needed to submit the content and allow us to process it. You are responsible for deciding what information is appropriate to place in a workspace and who receives access.
5. Acceptable use
You may not misuse the Service. In particular, you may not:
- violate applicable law or the rights of another person;
- upload malicious code or use the Service to distribute spam, fraud, or harmful material;
- probe, bypass, disable, or interfere with security or access controls;
- access accounts, workspaces, or data without authorization;
- overload, disrupt, scrape, or reverse engineer the Service except where applicable law expressly permits it; or
- use the Service to build or train a competing product without our written permission.
6. SiteBrew property
SiteBrew and its licensors retain all rights in the Service, including its software, interface, branding, and documentation. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while they remain in effect; they do not transfer ownership of the Service to you.
If you provide feedback, you allow us to use it without restriction or compensation, provided we do not identify you publicly without permission.
7. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. It is incorporated into these Terms by reference.
8. Suspension and termination
You may stop using the Service and request account deletion through the available account controls. We may restrict or terminate access when reasonably necessary to protect the Service or others, respond to legal requirements, address nonpayment where applicable, or enforce these Terms.
Provisions that by their nature should survive termination—including ownership, disclaimers, limits of liability, and dispute provisions—will remain in effect.
9. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
10. Limits of liability
To the fullest extent permitted by law, SiteBrew will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, use, or data arising from the Service.
Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Changes to these Terms
We may update these Terms as the Service or legal requirements change. We will post revised Terms here and update the effective date. If a change is material, we may provide additional notice. Your continued use after revised Terms take effect constitutes acceptance where permitted by law.
12. General
If a provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written permission; we may assign them in connection with a business reorganization or transfer of the Service.
